Sulle motivazioni della condanna d’appello al “sistema Montante”
Comunicato stampa dell’Associazione Antimafie Rita Atria
La Corte d’Appello di Caltanissetta ha pubblicato le motivazioni della sentenza di secondo grado – pronunciata nel luglio scorso – contro Antonello Calogero Montante e altri.
Abbiamo aspettato le motivazioni per esprimere in maniera informata le nostre valutazioni.
Lo hanno chiamato “sistema Montante”, una P2 siciliana: “Un uomo che ha creato dal nulla un’allarmante e pervasiva rete illecita, giunta a penetrare non solo nei vertici delle forze dell’ordine in ambito locale, ma anche a livelli apicali di organismi istituzionali operanti a livello centrale. (…) Finanziare le campagne elettorali di esponenti politici di diversi schieramenti per potere avere sempre un punto di riferimento in soggetti chiamati a rivestire incarichi di governo, così ponendo le premesse per il dispiegarsi della propria azione corruttiva” (limitatamente al reato associativo, Corte di Cassazione che ha annullato con rinvio al Riesame l’ordinanza del Tribunale di Caltanissetta -– fonte XVII LEGISLATURA ARS).
La Corte d’Appello ci restituisce il quadro di un sistema di potere e di un disinvolto piegare l’interesse pubblico a quello di Montante e della sua corte. Una corte in cui sono cresciuti e hanno fatto carriera presunti “antimafiosi”, “paladini della legalità” e simili. Un sistema che ancora oggi gode dello scudo dell’invisibilità dato dal silenzio di tanti, di troppi, mentre bisognerebbe far conoscere in ogni modo e con ogni mezzo possibile questo apparato in metastasi che uccide meritocrazia, economia, istituzioni, aziende, libertà di stampa. Che uccide la democrazia.
Nella relazione della commissione regionale di inchiesta ARS XVII legislatura si legge: “una sorta di cerchio magico – chiuso, aggressivo e sinergico – che ha accompagnato il presidente di Confindustria Sicilia nella progressiva erosione di legittimità delle istituzioni regionali, accentrando su di sé i compiti di decidere, premiare o punire” (relazione che invitiamo a leggere).
Una sentenza che per noi conferma l’esistenza di una struttura finalizzata al controllo di attività imprenditoriali rilevanti anche grazie alle godute coperture istituzionali di cui, però, Montante non era l’apice considerato che i vertici sono rimasti nell’ombra.
Rimane comunque confermato che Montante abbia creato una struttura che, sfruttando anche la complicità di apparati dello Stato, riusciva a ricattare i soggetti imprenditoriali sgraditi e, soprattutto, aveva creato una struttura che confezionava dossier su persone con funzioni istituzionali o anche su imprenditori per ricattarli ed eliminarli da mercato politico ed imprenditoriale.
E ricordiamo che già ben 9 anni fa, il 25 aprile 2014, I Siciliani Giovani di Riccardo Orioles pubblicò un articolo a firma Pino Finocchiaro e alcune foto (in una di queste foto, Montante compare accanto a Vincenzo Arnone, in un’altra c’è il certificato di matrimonio di Montante con la firma dei testimoni di nozze: sempre Vincenzo Arnone e Paolino Arnone), perché, a far saltare il banco oltre alle indagini della Procura e della Squadra Mobile di Caltanissetta e al senso civico di qualche funzionario indignato, c’è stato anche il buon giornalismo di inchiesta, etico e coraggioso.
Paolo Borsellino sosteneva che <<la magistratura può fare soltanto un accertamento di carattere giudiziale, può dire: beh! Ci sono sospetti, ci sono sospetti anche gravi, ma io non ho la certezza giuridica, giudiziaria che mi consente di dire quest’uomo è mafioso. Però, siccome dalle indagini sono emersi tanti fatti del genere, altri organi, altri poteri, cioè i politici, le organizzazioni disciplinari delle varie amministrazioni, i consigli comunali o quello che sia, dovevano trarre le dovute conseguenze da certe vicinanze tra politici e mafiosi che non costituivano reato ma rendevano comunque il politico inaffidabile nella gestione della cosa pubblica.>>… il nostro compito quindi è quello di analizzare relazioni, rapporti, pacche sulle spalle non per tradurli in condanne penali ma in condanne politiche.
Queste motivazioni, dunque, imporrebbero una seria e urgente analisi politica e sociale…Invece la prassi è la solita: qualche articolo sui giornali e poi silenzio: la tecnica del “Càlati juncu ca passa la china” (il significato si trova facilmente sul web).
Ma anche se si è in pochi bisogna andare fino in fondo, occorre sostenere chi va controcorrente, senza timori reverenziali e senza sconti a nessuno. Ce lo ha insegnato proprio Rita Atria che, con i suoi 17 anni ha capito che bisogna iniziare a sconfiggere “la mafia che è in noi”. I nostri compromessi; i nostri distinguo.
Dopo due gradi di giudizio riteniamo che certa antimafia possa e debba esprimere con la stessa forza con la quale difendeva la presunzione di innocenza del “paladino dell’antimafia”.
