Salvo Vitale in tribunale per una denuncia per diffamazione
Giorno 24 ottobre al tribunale di Palermo si è svolta l’udienza per una causa di diffamazione a mezzo stampa intentatami da Luigi Lazzara.
I fatti si riferiscono a un articolo pubblicato il 9.5.2005 sul sito www.peppinoimpastato.com, allora interamente gestito da me, dopo la morte di Guido Orlando (2012), con il quale lo avevamo fondato dieci anni prima. Era la prima volta che entravo in un’aula giudiziaria. L’impressione è stata quella di essere finito in una dimensione artificiale e artificiosa, in un mondo parallelo dove ognuno recita la sua parte, dall’avvocato in toga al giudice, al cancelliere, all’imputato, al testimone, secondo un cerimoniale con le sue regole. Un mondo dove esiste la “verità giudiziaria” che non sempre è la “verità reale”, dove esiste il fatto, la prova, il giudizio, in uno “status” spesso lontano dalla condizione umana con i suoi sentimenti, gli stati d’animo, le motivazioni spesso lontane che hanno determinato un gesto, una parola, uno scritto. Ci siamo intravisti con una persona, Lazzara, che si è definita “di sinistra”, vittima di minacce mafiose e che ha identificato i suoi nemici, le persone contro le quali agire, proprio in quel mondo dell’antimafia in nome del quale egli ha riferito di avere agito, ovvero in don Luigi Ciotti e in me.
L’articolo incriminato riportava il testo di don Ciotti dal titolo Il coraggio della verità, nel quale il fondatore di Libera rispondeva a un’indegna campagna di stampa condotta nei suoi confronti dai giornali del centro destra, i quali erano venuti a conoscenza di un episodio poco edificante: il prete avrebbe dato un pugno a Filippo Lazzara, che lo assillava perché voleva da lui un posto di lavoro. Nella sua nota Ciotti spiegava i fatti, il suo prodigarsi nei confronti del ragazzo e della sua compagna, aiutandolo fino a quando gli era stato possibile e poi l’inasprirsi dei rapporti a causa del carattere dello stesso ragazzo. Chi avesse venduto la notizia a Libero è un mistero, ma di facile soluzione. Il commento a fondo pagina non faceva altro che ribadire lo stesso giudizio dato da Ciotti. Lazzara ha riferito di avere ricevuto dei soldi da Don Ciotti per ritirare la denuncia, cosa che avrebbe poi fatto. Sono rimaste pendenti invece le vicende con Giovanni Impastato, che non c’entra niente, ma che, dopo la morte di Guido Orlando ha rilevato il dominio del sito e quindi la responsabilità, e di Salvo Vitale, accusato di avere detto che si trattava di uno “psicopatico”. A un anno e mezzo di distanza, mi è stata recapitata dal servizio di Polizia Giudiziaria una notifica di procedimento penale per diffamazione e l’invito a nominare un legale.
Tutto ciò malgrado avessi scritto alla compagna o amica di Lazzara, Antonella Zanotello Bianco, nel corso di una conversazione su Facebook e poi pubblicato sul sito una dichiarazione in cui, fra l’altro dicevo:
Se la parola psicopatico nei confronti di uno che esibisce a destra (giornale Libero) e a manca le “prove” del maltrattamento cui è stato sottoposto e non quelle di tutti i benefici che ha ricevuto, è parola d’offesa, mi dichiaro psicopatico io che uso chiavi di lettura del tutto personali e chiedo scusa a Filippo, che invece è una persona lineare, tranquilla e che, come tutti coloro che stanno vivendo questo difficile momento di crisi, ha solo la colpa di cercare lavoro. Va bene?
Non credo che davanti alla mia autodichiarazione di essere io psicopatico, colpevole di qualsiasi nefandezza possa avere commesso nei confronti di un “compagno” che non avevo avuto a prima vista l’impressione che fosse tale, di essere involontario o passivo amplificatore del pensiero e del giudizio di don Ciotti e infine di avere insinuato di sicuro erroneamente, che avevi venduto Ciotti a un giornale del centro destra, io potessi aggiungere altro. A quanto pare non è così. Premesso che non ho niente da poterti offrire in caso di condanna, mi chiedo che compagno sei, tu, che compagna sia la tua amica che cita a sproposito Peppino Impastato e tutti coloro che pensano di potere spremere qualcosa sulla pelle di altri compagni. I soldi vanno cercati altrove, nelle tasche dei capitalisti. E credimi, alla base c’è solo la curiosità di capire cosa vuol dire per te essere compagno. Per me essere compagni prima di ogni cosa significa condividere idee, momenti di lotta, pane, parlarsi, dirsi in faccia tutto e prendere intanto un caffè assieme. Quando vuoi. Ciao. Salvo Vitale
P.S.: Naturalmente pubblico copia di questa lettera anche sul sito, a riprova della mia intenzione di fare ammenda, non voler calunniarti, ma di ribadire, più o meno lo stesso giudizio espresso dal sacerdote, ribaltando addirittura su me stesso il giudizio di psicopatico, nella misura di un uomo che si trova a reagire con rabbia nei confronti delle ingiustizie della società in cui vive.
Tutto ciò non è bastato a Filippo, che ha voluto procedere, sentendosi offeso solo perché, ho fatto riferimento ad alcune affermazioni fatte da don Ciotti: e l’ho definito un “mascalzoncello”, perché si era rivolto al Giornale e a Libero, che hanno montato un’indegna campagna di stampa e “uno psicopatico”, a causa dei suoi problemi e atteggiamenti evidenziati da don Ciotti, il quale, fra l’altro scrive:
Filippo è impulsivo, conflittuale, indisponibile a stabilire un rapporto rispettoso con le persone che lavorano in Certosa, dagli operatori agli operai impegnati nel cantiere. Un giorno arriva a minacciare un muratore colpevole secondo lui di importunare la sua ragazza. Ma non si tratta solo di diverbi o atteggiamenti aggressivi. Filippo è preda di vere e proprie fissazioni. Più volte i Carabinieri di Avigliana vengono chiamati perché lui assicura di aver visto aggirarsi presenze ostili, un’altra volta è dovuta intervenire una funzionaria della Questura di Torino. Gli allarmi si rivelano sempre infondati…… Nel frattempo, vista la sua fragilità, gli consiglio di essere seguito da uno psicoterapeuta e da un neurologo che lo sorreggano e aiutino nei suoi momenti di difficoltà: Filippo accetta il consiglio.
Per me è stata comunque un’occasione per reincontrare dopo molto tempo Giovanni Impastato, il quale, chiamato a testimoniare ha ribadito la piena fiducia data a chi allora si occupava del sito, e quindi alla pubblicazione dell’articolo che ha portato alla denuncia. L’avvocato della difesa, Bartolo Parrino, ha chiesto di potere ascoltare in aula don Luigi Ciotti e Pino Maniaci, al quale si era rivolto Lazzara per chiedere la pubblicazione della notizia delle percosse ricevute da don Ciotti.
Quella di fare una guerra “tra poveri” e di trovarmi in tribunale con una richiesta di 20 mila euro di risarcimento per essermi schierato a difesa di un sacerdote verso il quale nutro grande stima, è l’ultima cosa che poteva succedermi, dopo una vita passata a sostenere che il nemico contro cui combattere è la mafia e non chi la combatte. Ed è la prima di una serie di altre denunce che mi sono ultimamente piovute addosso e hanno seriamente messo in crisi la mia fiducia in una stampa libera e in una giustizia “giusta”.
