Non hanno commesso il fatto, non c’è stata nessuna Trattativa
(e nessuno rompa più i coglioni)
Il percorso dei tre gradi di giudizio del processo sulla trattativa Stato-mafia ci dà un quadro completo dell’evoluzione di un iter giudiziario che ha visto sul banco degli imputati mafiosi, funzionari dello stato e politici. In primo grado, con sentenza del 20 aprile 2018, dopo quattro giorni di camera di consiglio, il presidente della Corte d’Assise di Palermo, Alfredo Montalto ha letto la sentenza che condannava Leoluca Bagarella, a 28 anni, il medico di Totò Riina, Antonino Cinà a 12 anni, la stessa pena era data agli ufficiali del Ros Antonio Subranni e Mario Mori, e al senatore Marcello Dell’Utri e 8 anni, all’altro militare dei Ros Giuseppe De Donno. Otto anni per Massimo Ciancimino, colpevole di aver calunniato l’ex capo della Polizia Giovanni De Gennaro. In quella sentenza era scritto che “Al Subranni, invero, deve ricondursi l’ideazione della trattativa con i vertici mafiosi da cui ebbe a scaturire la minaccia rivolta da questi al governo della Repubblica. Subranni, infatti, ha recepito (anche) le preoccupazioni esternategli in modo sempre più pressante, già all’indomani dell’uccisione di Salvo Lima, da Calogero Mannino, il quale temeva – deve dirsi, peraltro, fondatamente – di poter essere una delle possibili successive vittime della vendetta (…) In tale contesto, nasce l’iniziativa del Ros comandato da Subranni diretta a intraprendere i contatti con Vito Ciancimino col fine precipuo di raggiungere, attraverso l’intermediazione del predetto, che si sapeva essere particolarmente vicino ai corleonesi di Cosa Nostra, direttamente i vertici dell’associazione mafiosa”.
Passano poco più di tre anni e il 23 settembre 2021, in corte d’Assise, presidente Angelo Pellino, tutto è ribaltato. Condanna solo per Bagarella e Cinà e assoluzione per Subranni, Mori e De Donno perchè il fatto non costituisce reato, benedizione assolutoria per Dell’Utri “per non aver commesso il fatto”. Quindi la trattativa ci fu, fu fatta dal Ros, ma senza dolo, fu “un’azione improvvida”, perché pensata con “fini solidaristici”.
Per contro con la sentenza definitiva del 27 aprile 2023 i Supremi giudici della sesta sezione penale, presieduta da Giorgio Fidelbo, hanno respinto in ogni parte il ricorso della Procura generale di Palermo contro la sentenza assolutoria precedente e potremmo dire che “ci hanno messo il carico”, trasformando la motivazione della sentenza. Non che “il fatto non costituisce reato”, ammesso che trattare con la mafia non comporti il reato di concorso in associazione mafiosa, ma “per non aver commesso il fatto”. Non si tratta di differenza tecnica: la sentenza assolutoria d’appello riconosceva il fatto, ovvero l’esistenza della trattativa, ma non lo condannava, anzi lo giustificava in virtù dei suoi fini solidaristici, potremmo dire di pubblica utilità o di azione consumata per il bene dello stato. La negazione dell’esistenza del fatto è invece una totale cancellazione di tutto, un tombale e definitivo “non è successo niente”, a distanza di cinque anni dalla prima sentenza. Indubbiamente il clima è cambiato. L’ Associazione tra i Familiari delle Vittime della Strage di Via dei Georgofili di Firenze, ha commentato il dispositivo della Cassazione sostenendo che per 5 sentenze precedenti la trattativa Stato-mafia del 1992 c’è stata; resta dunque il fatto storico inoppugnabile che quella trattativa, interrotta con la cattura di Riina, portò alle stragi in continente del 1993”.
Sulle ininterrotte trattative tra lo Stato e alcuni settori bene organizzati della delinquenza economica, politica, militare è stato scritto molto, dalla mafia al terrorismo fascista: le “stragi di Stato”, a partire da Portella della Ginestra, e l’impunità di cui hanno goduto mandati ed esecutori, sono ormai diventate verità storiche, alle quali non corrispondono quasi mai le verità giudiziarie. In Sicilia, in particolare un complesso e quasi sotterraneo sistema di potere ha strangolato l’isola rendendola una terra di consenso elettorale in cambio di briciole o di grossi interessi equamente divisi tra gli industriali del nord e i ceti parassitari del sud. Il procuratore di Palermo Francesco Messineo, interrogato alla Camera il 17 luglio 2012, aveva sostenuto che la trattativa tra lo Stato e la mafia “c’è stata ed è stata reale”. Si potrebbe anche aggiungere che il dialogo tra le parti criminali e alcuni rappresentanti dello stato, è entrato talmente nei meccanismi di lettura storica e in quelli di assuefazione mentale e ideologica, da sembrare naturale, da non stupire più nessuno, da essere addirittura legittima e legittimata. Ma di là ad arrivare alla negazione dei fatti per “sentenza”, al decretare che non è successo niente, a negare testimonianze e dichiarazioni di protagonisti dei fatti, con il fine ultimo di tutelare l’intoccabilità e l’integrità di alcuni “pezzi dello stato”, non certo di tutti, ci vuole coraggio e faccia tosta, è come professarsi più credenti del papa. In uno stato che rispetti la dignità delle sue leggi, tutti coloro che hanno testimoniato cose che la Corte non ha ritenuto attendibili, andrebbero giudicati per calunnia o per falsa testimonianza, ma tranquilli, non succederà mai neanche questo. Ormai, dice Peter Gomez, “nelle sentenze puoi scrivere quello che vuoi”.
Davvero amara la considerazione di Salvatore Borsellino: “Non ho mai creduto alla Giustizia degli uomini, sono laico e non posso quindi confidare neanche nella Giustizia di Dio, non mi resta, nei pochi anni che mi restato da vivere, che la lotta, una lotta disperata, solitaria, senza speranza, per una Verità che continuerà ad essere occultata, vilipesa, negata dagli stessi assassini che mai, mai, potranno giudicare sé stessi”.
